Eastern Metropolitan Club

1. Name of the Club

The Club shall be called Eastern Metropolitan Club, hereafter referred to as the Club, situated at Nandan Kanan Road, Survey Park, Kolkata 700075, and it is a proprietary club owned and promoted by Samar & Samar Infrastructure Development Private Limited having its registered office at 103B, Dr. Suresh Chandra Banerjee Road, Kolkata 700010.

2. Object of the Club

To promote social, cultural and sports activities emphasizing on social awareness and to provide recreation and refreshments to the members of the Club.

3. The Club Management
  • The Club shall be managed through the Committee of Management (hereinafter referred to as Club Management) consisting of President, Secretary, as office bearers and other members nominated and/or selected by the management of Samar & Samar Infrastructure Development Private Limited.
  • The Club Management as and when necessary may form a number of Advisory Committees/Bodies for assisting and advising the Secretary for the smooth running and functioning of the Club.
4. Club Hours

The club hours shall be from 7:30 A.M. to 11:30 P.M. The Club Management at its sole discretion may alter the club hours as it may deem fit and proper.

5. The Right of Admission

The right of admission to the club is restricted and reserved with the Club Management.

6. Membership
6.1. Life Member

Any person of 25 years of age or above and well accepted in the society or a person of repute and dignity and who agrees to observe, perform and consents to abide by the rules, regulations, bye-laws of the club and the amendments thereof can apply for Life Membership. Life Members shall not have any right, title or interest of whatsoever nature in respect of the movable and immovable properties of the club.

6.2. Honorary Member

Any person of distinction or prominent personality may, at the discretion of the Club Management, be enrolled as an Honorary Member for a specific period and terms. Honorary Members shall not have any right, title, or interest in the Club’s movable or immovable properties.

6.3. Temporary Member

Any person of 25 years of age or above and of good reputation may be admitted as a Temporary Member upon selection by the Club Management for a specific tenure.

6.4. Institutional Member
  • A registered company, statutory body, or corporation may apply to become an Institutional Member for a 5-year period by paying the stipulated fees and abiding by the Club's rules and regulations.
  • Institutional Members may subscribe for one or more blocks, each block having 4 nominees, subject to approval by the Club Management.
6.5. Spouse, Parents & Dependent Children

The spouse, parents, and dependent children (below 25 years of age) of Life Members, Honorary Members, and Institutional Members are entitled to Add-On Identity cards and privileges as stipulated.

7. Membership Cards/Devices

Members, spouses, and dependent children must use Membership or Add-On Identity cards/devices when entering the Club or availing services. Misuse of these cards may result in membership termination.

8. Guests of Members

Members (except Seasonal Members) may bring guests by recording their details in the entry register. The Club Management reserves the right to restrict guest privileges.

9. Fee Structure
  • Admission Fee: Non-refundable, as decided by the Club Management.
  • Monthly Subscription: Payable by all members as per the prevailing rates.
  • Minimum Billing: Levied on members if expenditure at the bar and restaurant falls short of the set amount for a specific period.
10. Credit Limit

Members' credit amount cannot exceed the limit set by the Club Management, which reserves the right to modify or withdraw the credit limit based on past payment records.

11. Facilities/Amenities and Charges

The Club offers a number of facilities, amenities, and services for sports, games, entertainment, food & beverages (alcoholic and non-alcoholic), swimming, gymnasium, banquets, and accommodation for members and their guests at uniform rates.

  • Members, in addition to charges under Clause 9.0, will pay for these facilities at prevailing rates as decided by Club Management.
  • Multi-cuisine restaurant and lounge bar services are available exclusively for members and their guests. Guests must be accompanied by members or their spouses, and guest charges apply.
  • Table Tennis, Billiards, and outdoor Badminton are free for members, but guest charges apply.
  • Seasonal members can access Swimming, Lawn Tennis, Gym, and Skating, with different charges for club members and seasonal members.
  • Banquet bookings are available exclusively for members at prescribed rates.
  • Exclusive dining rooms and bars are available with advance booking and charges as determined by Club Management.
12. Signing of Credit Memos

Members eligible for credit, including their spouses, may use club facilities and pay by signing credit memos, which must include their name and membership number, shown with their membership card. Credit memos without membership numbers and signatures will not be accepted.

13. Settlement of Bills

Bills are generated on the 1st day of every month, including opening balances and the previous month's expenditures. Bills must be paid by the last day of the billing month and are sent via email within the first 10 days of each month. Members can request postal delivery if needed.

14. Consequences for Non-Payment of Dues
  1. Bills become due on the 1st day of the next month and must be paid by the last day. Failure to do so results in default.
  2. Defaulting members will lose access to facilities and services until dues are cleared within 30 days.
  3. Membership may be terminated if dues are unpaid for over 30 days.
15. Use of Funds of the Club

Club Management has sole authority over the investment and use of club earnings. Members cannot object or make claims against management decisions.

16. Use of Club Premises

Specified club areas are for member activities. Food and drinks are restricted to specified areas and times. Club Management may host events, restricting access to certain areas temporarily.

17. Suspension/Expulsion of Membership
  1. Club Management may suspend or expel members for the following reasons:
    • Criminal offenses, insolvency, or liquidation.
    • Failure to pay dues within a month of the due date.
    • Violation of club rules, misconduct, or nuisance.
    • Incitement against club authority or misuse of membership privileges.
  2. Members are responsible for their guests' actions, and violations may lead to penalties.
  3. Membership termination involves surrendering cards/devices, and no refunds are provided.
18. Services Subject to Contingencies

Services and facilities are subject to availability and unforeseen circumstances such as natural calamities, legal directives, or labor unrest.

19. Compliance with Rules and Regulations

All members must comply with rules, regulations, and decisions made by Club Management.

20. Removal or Damage to Club Property

Members and guests must respect club property. Damages caused by members or their guests must be compensated along with additional fines, as determined by Club Management.

21. LOSS OF MEMBER'S PROPERTY:

The Club or CLUB MANAGEMENT shall not be liable or held responsible for loss of money, valuables or other property belonging to any member or guest in whatever manner, notwithstanding that such loss may be caused by acts or omission of the servants and other employees of the Club in course of employment. In the event of any such loss it shall be the duty of the member concerned to report the same in the first instance to the reception office for necessary enquiry and action for recovery of the lost article and intimation to the member concerned in case of recovery. It shall be lawful for the Club without giving any notice, in that behalf, to sell or dispose of through public auction or private treaty any unclaimed property found in the Club premises and not collected by any one on the following day in case of perishable property and in other cases within a period of 7 (seven) days from the date of intimation. The sale proceed thereof shall form part of the property and assets of the Club. The owner or any person claiming any interest in such property shall not have any claim of whatsoever nature against the Club on account of any loss suffered by him.

22. RULES FOR USING SPORTS AND PASTIME FACILITIES:
  1. Sports and pastime facilities shall be available for the members and the accompanied Guests of members on payment of such charges as levied by the Club from time to time.
  2. Rules for participation in individual games/pastimes facilities will be available on the notice board of each game area. Entry of children below the age of 12 years may be restricted to certain areas.
  3. Rules for participation may be changed at the discretion of Club Management.
  4. Club Management will have the power to frame, amend, alter, modify or add to the existing rules from time to time.
  5. The Club Management shall have the power to exclude any member from participation in any game whose conduct is not in consonance with the Rules, Regulations and By-laws of the Club for any period not exceeding four months for the first offence and one year for the second offence.
  6. In case of damage of equipment, accessories, tool kits (e.g., rackets, balls, etc.) due to misuse or mishandling by a member or the accompanied guests, the concerned member shall be liable to pay compensation as determined by the Club.
  7. No companions/guests will be allowed with seasonal members excepting children up to 18 years of age.
23. ACCIDENT/ INJURY:

The Club Management will not be responsible or liable for any accident or injury caused to the member, his /her children and/or guests of member during their presence in the Club, or due to any sporting activity or negligence or due to the acts or omission on the part of servants and other employees of the Club acting in course of their employment. Individual members may take out their own insurance throughout the duration of their membership.

24. COMMUNICATION:

Any notice or communication sent to a member through any of the following modes shall be deemed to have been properly delivered:

  • By e-mail to the e-mail ID of the member as recorded with the Club; or
  • By SMS to the mobile number of the member as recorded with the Club; or
  • By post to the postal address of the member as recorded with the Club.

Any communication shall be deemed to have been properly delivered after:

  1. Expiry of 72 hours of dispatch by Speed Post/Courier, and
  2. Expiry of 24 hours after sending the e-mail or SMS by the Club.

The member should intimate the Club immediately if there is any change in their address for communication, including e-mail ID or mobile number. Members shall communicate with the Club through:

  • Courier service
  • E-mail
  • SMS
  • Personally delivering the communication at the Club office

Communication by members through courier service, e-mail, or SMS shall be deemed to have been properly delivered on the date of its receipt by Club Management.

25. JURISDICTION: Management of the club shall always be subject to jurisdiction of the High Court at Calcutta.
26. CONSTRUCTION OF RULES:

Club reserves the Rights of admission and entry to the Club and shall have absolute discretion and uncontrolled powers to amend whenever considered necessary without prior intimation , these Rules, Regulations , Code of Conduct & By-Laws as well as applicable Fees, Deposits, Subscriptions and other Charges payable by the members and upon acceptance of membership, the members shall be deemed to have confirmed and agreed to the prevailing Rules, Regulations, Code of Conduct and By-Laws and any amendment thereto, from time to time save and except with retrospective effect.

27. COMPLAINTS AND DISPUTE RESOLUTION:
  • 1. All complaints shall be made in writing to the Club Secretary.
  • 2. All complaints made before the Club Secretary shall be considered and decided by him as to whether it has to be referred for Dispute Resolution Process under Clause
  • 3 or it is to be decided by the Club Secretary himself and decisions of the Club Secretary will be final and binding upon the members of the club.
  • 4. In the event the Club Secretary decides not to adjudicate himself any complaint/dispute brought up before him may refer the same to an independent One- Man Committee formed by the Club Secretary from amongst the members of the Club at the earliest opportunity for adjudication of the issues involved. The One-Man Committee shall enquire into the allegations raised and give an opportunity to the defendant to justify his conduct/action. The One-Man Committee shall submit its report containing its observation and recommendation within 60 days to the Club Secretary who shall take necessary action on the basis of the recommendation of the One-Man Committee giving appropriate directions. The decision arrived at by the Secretary shall be binding upon the Members irrespective of their category.
28. PETS :
Pets are not permitted within the Club compound.
29. NOTICES :
29.1. No paper, notice or placard, written or printed, shall be posted in the Club premises except by the Club Management. 29.2. Any member desiring to place an outside poster on the notice board must seek permission from the appropriate authority upon payment of requisite charges for the facility.
30. RESTRICTIONS ON USE OF CLUB PREMISES, ADDRESSES / PERSONAL DATA/ CLUB’S OFFICIAL MEDIA:
  • 1. No member shall give the address of the Club in any advertisement or use the Club, or Club address, for business purposes.
  • 2. No member shall use or distribute any other member's personal data outside the club.
  • 3. No member shall use the Club premises for gambling and /or betting.
  • 4. No member is allowed to organize, promote or patronize private events competitions, lotteries or prizes inside the club premises without prior permission of the Club.
  • 5. No member is permitted to post any personal messages, publicity materials or the like in the official media of the Club administered by the Club authority.
  • 6. Any violation of the above sub rules under Rule 30 shall attract the provisions of Rule 17 above.
31. EXTERNAL FOOD AND DRINKS :

External food and drinks are not allowed in the Club excepting the banquet parties where external caterers are allowed to work as per prior understanding and agreement. The Banquet parties and the activities of the seasonal members are not included in the club activities.

32. CAR PARKING:

Parking of cars by members shall be subject to availability of parking space and no car will be allowed to be parked in the club's parking lot if it does not display the car parking sticker of the club. Members’ cars with stickers pasted on the windscreen can be parked at the area earmarked for the members subject to availability of parking space. Car stickers as available for members at Club Reception are not TRANSFERABLE and should not be lent or used by another person other than whom those were issued. Members must not allow misuse of the allotted stickers in any manner. Any violation of this Rule shall attract the provisions under Rule 17 above.

33. DRESS CODE:

The Dress Code for members and their guests, as notified from time to time by the Club Management, unless relaxed on specific occasions, have to be strictly adhered to. Members are hereby requested to adhere to the dress code.

34. AMENDMENT OF RULES & REGULATIONS :

The Club Management reserves the right to alter, add, delete and amend the Club rules and regulations from time to time as may be deemed fit and proper for smooth functioning and operation of the club.

35. MISCELLANEOUS:
  • 1. The Club shall not to be held responsible for any misconduct of a member or spouse and/or children and/or guest of a member.
  • 2. Words importing singular number shall include plural number and vice-versa.
  • 3. Words importing MASCULINE GENDER shall include FEMININE GENDER and vice-versa and similarly words importing neutral shall include MASCULINE GENDER and FEMININE GENDER as the case may be.
36. DATE OF EFFECT

These Rules shall take effect from 01.04.2021 and supersede all previous Rules and Regulations of the Club along with the Notifications published by the Club Management.
